GoTo Digital Marketing Limited (“GoTo”) takes your privacy and the protection of your personal information very seriously. Any reference to “we”, “us” or “our” in this policy is a reference to GoTo.

3. The information we collect about you

We use different methods to collect data from and about you including through direct interactions. For example, you may provide us with your personal data by filling in forms or by corresponding with us by post, phone, email or otherwise.

You can browse the GoTo Site without entering any personal information. However, if you choose to request information about a product or service which is being advertised on the GoTo Site or any of the products or services we or a Third Party (as defined below) offer, you will be asked to provide us with personal information through a request form. Information we collect may include: your name, email address, telephone number and postcode.

In certain circumstances, to process your request, we may request that you provide us with certain sensitive personal data (as defined in the applicable data protection laws from time to time, and includes: [gender]) in which event we will only collect and process such data where we have obtained your explicit consent.

We endeavour to only collect the minimum amount of information necessary to fulfil your request. However, some of the information that we ask you to provide is mandatory and if you do not provide it, we may not be able to action your request.

You have the right to opt-out of any of the Third Party’s marketing communications and, unless expressly stated otherwise and having obtained the necessary consents from you, the Third Party will only contact you for the Purpose.

The Third Party has agreed and has provided the necessary confirmation and warranties to GoTo, that it will only use your personal information where you have provided your consent on the GoTo Site and that it will process your personal information for the Purpose and in accordance with this policy and on GoTo’s instructions. For the purpose of this policy and the processing in relation to the Purpose, the Third Party is a data controller and, therefore, you should, in the event that you wish to exercise any of your legal rights in relation to your data (including those set out in paragraph 11) held by a Third Party, consult the privacy policy of the relevant Third Party.

The GoTo Site uses cookies. Cookies are text files placed on your computer to collect standard internet log information and visitor behaviour information. These cookies allow us to distinguish you from other users of the GoTo Site which will help us to provide you with an enhanced user experience when you use the GoTo Site and allows us to continuously improve the GoTo Site. You can set your browser to refuse all or some browser cookies, or to alert you with the GoTo Site sets or accesses cookies. If you disable or refuse cookies, please note that some parts of the GoTo Site may become inaccessible or not function properly.

We adhere to highly stringent security measures to protect your personal information from misuse, loss or alteration. Only persons who have agreed to protect and keep confidential your personal information in line with this policy and our practices relating to data protection and confidentiality have access to your personal information you provide to us.

We take all appropriate measures to protect personal information; however, as any transfer of data over the internet is not completely secure we cannot guarantee absolutely the security of data transmitted to us over the internet. We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

9. Transfer of personal information

When necessary and in very limited circumstances, your personal information may be transferred to and stored outside of the United Kingdom. This includes countries outside of the European Economic Area (“EEA”) which may not have local laws which specifically provide protection for personal information. Where your personal information is collected within the EEA and transferred out of the EEA, it will only be transferred where: the recipient is located in a country which provides an adequate level of protection; and/or, an agreement is in place which includes contractual clauses that are of a standard approved by the European Commission for the purposes of transferring personal information outside of the EEA.

In accordance with this policy, we may transfer or disclose the personal data we collect to subcontractors and to their third party contractors and their subsidiaries and affiliates. This may be necessary for administrative, security, storage and management purposes and to process the information for the reason it has been submitted on the GoTo Site and we will, where it is necessary to share your personal information in this way, ensure that there are necessary data protection and confidentiality protections in place with such third party affiliates.

10. Applicable law

The terms of this policy, its subject matter and its formation are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction.
